Online Platforms Terms of Service

Please read these terms and conditions carefully before using our services.

1. Acceptance of Terms

By accessing or using any online Epilog Laser services, including our ecommerce website (“Shop”) and the Epilog Portal (“Portal”), you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all visitors, users, and customers who access or use our services.

Important Note: These Terms govern the use of our online platforms only. They do not cover warranties, service agreements, or terms related to the physical products themselves.

If you disagree with any part of these Terms, you may not access our services. You represent that you are over the age of 18 or have legal guardian consent. The Company does not permit those under 18 to use the services without guardian consent.

2. Interpretation and Definitions

2.1 Interpretation

The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.


2.2 Definitions

For the purposes of these Terms and Conditions:

  • Account means a unique account created for You to access our Service or parts of our Service, including accounts managed through Azure Active Directory for Portal access.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Epilog Corporation, 16371 Table Mountain Parkway, Golden, CO 80403, United States.
  • Country refers to: Colorado, United States.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
  • Goods refer to the items offered for sale on the Shop.
  • Orders mean a request by You to purchase Goods from Us.
  • Portal means the Epilog Portal, a web-based platform that provides Epilog Laser customers and distributors with access to machine information, documentation, support case management, order tracking, technical resources, and account management tools.
  • Service or Services refers collectively to Shop and Portal, or individually as the context requires.
  • Shop refers to the Epilog Laser ecommerce website, accessible from shop.epiloglaser.com.
  • Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Services.
  • Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

3. Description of Online Platform Services

3.1 Shop Services

The Shop is an ecommerce platform offering Epilog Laser products, parts, and accessories for sale. Through the Shop, you may:

  • Browse and purchase Goods
  • Place and track Orders
  • Access product information and specifications
  • Manage your shopping account

3.2 Portal Services

The Epilog Portal is a web-based platform that provides authorized Epilog Laser customers and distributors with access to:

  • Machine information and documentation
  • Support case management
  • Order tracking and history
  • Technical resources and downloads
  • Account management tools

Access to the Portal is limited to authorized Epilog customers and distributors. Your Portal account provides access only to information related to your own machines, orders, and support cases.

4. User Accounts

4.1 Account Creation and Eligibility

Your Epilog account provides unified access to both the Shop and Portal through Azure Active Directory. When You create an account with Us, You must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account.

To create and maintain an account, you must:

  • Provide accurate and complete information
  • Be 18 years or older or have legal guardian consent
  • Maintain current contact and account information

Portal Access Requirements: While all customers can create an account to use the Shop, access to the Portal is limited to authorized Epilog customers and distributors. Portal access is granted based on your customer or distributor status and provides access only to information related to your own machines, orders, and support cases.


4.2 Account Security and Responsibilities

You are responsible for safeguarding the password that You use to access the Services and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

You may not:

  • Use as a username the name of another person or entity or that is not lawfully available for use
  • Use a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization
  • Use a name that is otherwise offensive, vulgar or obscene
  • Share your account credentials with unauthorized persons

4.3 Data Accuracy

You must:

  • Ensure information you provide is accurate and current
  • Notify us promptly of any changes to your account information
  • Report suspected unauthorized access to your account immediately

5. Acceptable Use Policy

5.1 Permitted Uses

Shop:

  • Browse and purchase Goods
  • Place and manage Orders
  • Access product information
  • Use the Shop for legitimate purchasing purposes

Portal:

  • Access your own machine information, support cases, and orders
  • Access technical documentation and resources related to your equipment
  • Communicate with Epilog Technical Support through the Portal
  • Use the Portal for legitimate business purposes related to your Epilog equipment

5.2 Prohibited Uses

You may not:

  • Attempt to gain unauthorized access to any part of the Services or other users’ data
  • Use automated systems (bots, scrapers) to access the Services
  • Use the Services for any unlawful purpose or in violation of applicable laws
  • Interfere with or disrupt the Services’ operation or security
  • Upload malicious content or attempt to introduce viruses or malware
  • Reverse engineer, decompile, or attempt to extract source code
  • Access or attempt to access other users’ information without authorization
  • Violate any applicable laws or regulations
  • Use the Services in violation of your organization’s internal policies

6. Placing Orders for Goods

6.1 Legal Capacity

By placing an Order for Goods through the Shop, You warrant that You are legally capable of entering into binding contracts.


6.2 Your Information

If You wish to place an Order for Goods available on the Shop, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.

You represent and warrant that:

  • You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and
  • The information You supply to us is true, correct and complete.

By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.


6.3 Order Cancellation by Company

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

  • Goods availability
  • Errors in the description or prices for Goods
  • Errors in Your Order
  • If fraud or an unauthorized or illegal transaction is suspected

6.4 Your Order Cancellation Rights

Any Goods you purchase can only be returned in accordance with these Terms and Conditions and Our Returns Policy (Section 7).

Your right to cancel an Order only applies to Goods that are returned in the same condition as You received them. You should also include all of the products instructions, documents and wrappings. Goods that are damaged or not in the same condition as You received them or which are worn simply beyond opening the original packaging will not be refunded. You should therefore take reasonable care of the purchased Goods while they are in Your possession.

We will reimburse You no later than 14 days from the day on which We receive the returned Goods. We will use the same means of payment as You used for the Order, and You will not incur any fees for such reimbursement.

You will not have any right to cancel an Order for the supply of any of the following Goods:

  • The supply of Goods made to Your specifications or clearly personalized.
  • The supply of Goods which according to their nature are not suitable to be returned, deteriorate rapidly or where the date of expiry is over.
  • The supply of Goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
  • The supply of Goods which are, after delivery, according to their nature, inseparably mixed with other items.
  • The supply of digital content which is not supplied on a tangible medium if the performance has begun with Your prior express consent and You have acknowledged Your loss of cancellation right.

7. Return Policy

7.1 Engraving Machines

Epilog Corp. guarantees online sales only for Engraving Machines with a 30-day return window beginning on the date of receipt of the product. The 30-day return window does not apply to products purchased through a 3rd party.

Within the thirty (30) days you may exercise your right to return your purchase. A refund will be issued once the machine has been returned and all items are accounted for. Returned items are subject to a ten percent (10%) restocking fee. Refunds cannot be issued for leased equipment. Return shipping costs are the responsibility of the customer.

All returns must be postmarked within thirty-one (31) days of the shipping date. All returned items must be in new and/or lightly used condition with original packaging and machine/accessories included. Boxed items can be opened, but all original packaging must be included.


7.2 Parts and Accessories

For parts and accessories, item(s) need be received at our warehouse within 90 days of the original purchase and item(s) must be in like-new condition. We understand there are times where items will need to be installed for troubleshooting purposes and take this into account when reviewing the condition upon return.


7.3 Return Process

Prior to returning any items or machines, please reach out to TSReturns@EpilogLaser.com and we can provide you with an RMA number to ensure timely processing of your return upon receipt.

Please note, the cost of the return shipping is the responsibility of the customer. If the item is lost or damaged in transit, Epilog Laser is not responsible for the value of the items, therefore we encourage you to get insurance on your return shipment for the full value of the items and use a trackable service.

8. Availability, Errors and Inaccuracies

We are constantly updating Our offerings of Goods on the Shop. The Goods available on Our Shop may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods on the Service and in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

9. Prices Policy

The Company reserves the right to revise its prices at any time prior to accepting an Order.

The prices quoted may be revised by the Company subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges, higher foreign exchange costs and any other matter beyond the control of the Company. In that event, You will have the right to cancel Your Order.

10. Payments

All Goods purchased are subject to a one-time payment. Payment can be made through various payment methods we have available, such as Visa, MasterCard, American Express cards or online payment methods (PayPal, for example).

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.

11. Intellectual Property

11.1 Company’s Rights

The Services and their original content (excluding Content provided by You or other users), including software, documentation, graphics, features and functionality are and will remain the exclusive property of the Company and its licensors.

The Services are protected by copyright, trademark, and other laws of both the Country and foreign countries.

Our trademarks, logos, service marks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

For Portal users, you are granted a limited, non-exclusive license to use the Portal for its intended purpose only.


11.2 User Content

You retain ownership of content you upload to the Services (such as support case attachments, communications, or feedback).

By uploading content, you grant Epilog a license to use, store, and process that content to provide the Services.

You represent that you have the right to upload any content you provide.


11.3 Your Feedback to Us

You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

12. Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy, which is incorporated by reference into these Terms. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

13. Service Availability and Modifications

13.1 Service Level

We strive to maintain Services availability but do not guarantee uninterrupted access. The Services are provided “AS IS” without warranties of any kind.

Scheduled maintenance will be announced in advance when possible.

We reserve the right to modify or discontinue features without notice.


13.2 Updates and Changes

We may update the Services’ functionality and these Terms at any time.

Material changes to Terms will be communicated via email or notification through the Services.

Continued use after changes constitutes acceptance of new Terms.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Services after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Services.

14. Links to Other Websites

Our Services may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

15. User Responsibilities

You agree to:

  • Comply with all applicable laws and regulations
  • Follow your organization’s internal policies regarding system access
  • Use the Services in a professional and appropriate manner

16. Limitation of Liability

16.1 Service Limitations

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. EPILOG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


16.2 Excluded Damages

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Services or 100 USD if You haven’t purchased anything through the Services.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Services, third-party software and/or third-party hardware used with the Services, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

EPILOG SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

17. Indemnification

You agree to indemnify and hold harmless Epilog Laser, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of applicable laws or regulations
  • Your infringement of third-party rights
  • Any content you submit or transmit through the Services

18. Account Termination

18.1 Termination by You

You may request account termination at any time by:

  • For Shop accounts: discontinuing use of the Service
  • For Portal accounts: requesting account deletion within the Portal

Upon termination, your access will be revoked and data may be deleted per our Privacy Policy.


18.2 Termination by Company

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if:

  • You breach these Terms or our Acceptable Use Policy
  • Your account becomes inactive for an extended period
  • Required by law or for security reasons
  • You are no longer an authorized Epilog customer or distributor (Portal only)
  • Fraud or unauthorized or illegal activity is suspected

Upon termination, Your right to use the Services will cease immediately.

19. Governing Law and Dispute Resolution

19.1 Governing Law

These Terms are governed by the laws of Colorado, United States, excluding its conflicts of law rules, shall govern these Terms and Your use of the Services. Your use of the Services may also be subject to other local, state, national, or international laws.


19.2 Dispute Resolution

If You have any concern or dispute about the Services, You agree to first try to resolve the dispute informally by contacting the Company through good faith negotiations.

If unresolved, disputes may be subject to binding arbitration. You retain the right to seek relief in small claims court for appropriate matters.


19.3 For European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

20. United States Legal Compliance

You represent and warrant that:

  • You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and
  • You are not listed on any United States government list of prohibited or restricted parties.

21. Severability and Waiver

21.1 Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.


21.2 Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

22. Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Services. You agree that the original English text shall prevail in the case of a dispute.

23. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us through the Services, constitute the entire agreement between you and Epilog regarding use of the Services and supersede all prior agreements and understandings.
